Terms of Service

These terms are between you and Thomas Simard ("fyel", "we") and cover using fyel. They apply from the moment you create an account. Subscribing asks you to confirm them expressly, and that confirmation is what forms the contract described below.
Language
These terms exist in French and in English, and the French version is offered to you first on the same site, at no cost. By reading and accepting the English version you are stating that you have been given the French version and wish to be bound by the English one. Where the two differ, the reading most favourable to you prevails, as Quebec's Consumer Protection Act provides.
Eligibility
You must be at least 16 years old to create a fyel account. If you are 16 or 17, you are subscribing to a study tool for your ordinary educational needs, which Quebec law lets a minor do alone; a parent or tutor may still cancel or manage the subscription on your behalf by writing to us.
What the service is
fyel is an educational tool: it interviews you to find your level, builds a study plan, teaches lessons and quizzes you with spaced repetition. The tutor you talk to is a language model, not a person. fyel is for educational purposes only and is not professional, medical or legal advice. Where a lesson's mathematics can be checked against a computer algebra system, fyel checks it and tells you when it could not — an unchecked step is taught as unchecked, never as verified.
Use is metered. Each calendar week carries a conversation budget, and it is counted per week whatever the length of your billing period. How large that budget is depends on the plan you chose; the amount is stated beside each plan before you subscribe, and again in your account. If a week runs it out, your pages, your topics, everything you have been taught and everything due to review stay available to you — the tutor stops writing new lessons until the budget refills on the Monday that follows. Your account shows how much of it you have used.
Subscription and billing
fyel is a paid subscription with no set term, billed in advance through Stripe's hosted checkout, on whichever plan and billing period you choose from those offered. The plans differ only in the size of the weekly conversation budget described above — every feature of the tutor is in each of them. The price shown on fyel's own pages is before tax; GST, QST or the sales tax of your province is added at checkout according to your billing address, and the exact total, the currency and the tax are shown on the Stripe page before you confirm anything. Access starts as soon as the payment goes through. The subscription renews automatically at the same price at the end of each billing period until you cancel.
Where a free trial is offered, no payment method is collected to begin it and nothing is charged while it runs. A trial does not turn into a paid subscription on its own: when it ends, access stops unless you have added a payment method and chosen to continue. The length of any trial is shown with the price, before you subscribe.
How this contract is formed under Quebec law
fyel is a distance contract with Thomas Simard (936 av. du Mont-Royal Est, 2e étage, Montréal (Québec) H2J 1X2, hello@fyel.io). Before you subscribe, Quebec's Consumer Protection Act requires us to disclose who you are contracting with, what the service is, what it costs including taxes, when it starts and how it is cancelled — all shown on this page and on Stripe's checkout page, where you can also correct any mistake before you confirm. Subscribing means checking a box confirming you have reviewed this and expressly consent to the contract. Within 15 days we send you a written confirmation by email that you can keep and print.
Quebec gives no cooling-off period for changing your mind about a distance contract, and neither do we. If, however, we fail to give you the disclosure above before the contract forms, or fail to send the written confirmation within 15 days, the Act lets you cancel the contract within 7 days of receiving the confirmation, or within 30 days of subscribing if none arrives. We then refund everything paid under it within 15 days, and if we do not, you may ask your credit card issuer for a chargeback within the following 60 days.
Cancelling
You can cancel at any time, without a reason and without any fee, from the billing portal linked in your account settings. Cancelling stops the next renewal; your access keeps running until the end of the period already paid, and that period is not refunded, since the service is supplied for the whole of it.
Deleting your account is different: it cancels the subscription immediately and ends your access on the spot, with no refund of the days left in the period. If you want to keep the days you have paid for, cancel from the billing portal first and delete the account once the period has ended.
We may end your subscription by giving you 60 days' written notice, or sooner if you breach these terms.
Acceptable use
Use fyel for your own learning. Do not use it to access another learner's data, to interfere with the service, or to extract copyrighted material through the tutor that you would not otherwise be entitled to. Upload only reference files you have the right to use.
Intellectual property
You keep the right to use the lessons and plan generated for you, and you keep your uploaded files. fyel keeps the underlying system, the software and the pedagogy behind it.
Responsibility
fyel is provided for educational purposes and we do not guarantee any particular learning outcome, exam result or grade. We are responsible for our own acts as Quebec law provides, and nothing here frees us from the consequences of our own fault or limits our liability for bodily or moral injury. We are not responsible for an interruption caused by a provider we depend on or by an event outside our control; if one stops the service for more than a few days, write to us and we will credit the time lost.
Ending your account
You can delete your account at any time: settings asks you to confirm, then emails you a one-use link, and following the link deletes the account. We may suspend or end an account that violates these terms.
Changes to these terms
We may change the price, the features of the service and the wording of these terms. Any such change is announced by email at least 30 days before it takes effect, and the notice shows the new clause, the clause it replaces, the date it comes into force and your rights. If a change increases what you owe or reduces what we owe you, you may refuse it and cancel without cost, penalty or fee up to 30 days after it takes effect. A change is never applied by posting it here alone.
Law and disputes
These terms are governed by the laws of Quebec, and nothing in them takes away a right Quebec or Canadian law gives you as a consumer. A dispute goes to the courts of Quebec, in the district where you live; nothing here obliges you to arbitrate or prevents you from joining a class action. You may also complain to the Office de la protection du consommateur. Nothing in these terms restricts you from publishing a review of fyel.
